ARTICLE 2 - SUBJECT OF THE AGREEMENT: The subject of this agreement is the sale and delivery of the goods/services ordered by the Buyer electronically from the Seller's website www.nutrafine.com, possessing the characteristics mentioned in the agreement and with the sales price also stated in the agreement, and the determination of the rights and obligations of the parties in accordance with the provisions of Law No. 4077 on the Protection of Consumers and the Regulation on the Principles and Procedures of Distance Contracts. The Buyer acknowledges and declares, in accordance with the terms of this agreement, that they are aware of the basic characteristics of the goods/services subject to sale, the sales price, the payment method, the delivery conditions, etc., all preliminary information regarding the goods/services subject to sale, and the right of withdrawal, that they have confirmed this preliminary information electronically, and that they subsequently placed an order for the goods/services. The preliminary information and invoice located on the payment page of the www.nutrafine.com website are integral parts of this agreement.

ARTICLE 3 - DATE OF AGREEMENT: This agreement, previously created by the seller, has been electronically approved and accepted by the buyer on ............. and a copy will be sent to the buyer's email address.

ARTICLE 4 - DELIVERY OF GOODS/SERVICES, PLACE OF PERFORMANCE OF THE CONTRACT AND DELIVERY METHOD: The goods/services will be delivered to the email address requested by the buyer, ..........

ARTICLE 5 - DELIVERY COSTS AND PERFORMANCE: Delivery costs are the responsibility of the buyer. If the seller has stated on the website that they will cover the delivery fee for purchases exceeding a certain amount, then the delivery cost is the responsibility of the seller. Delivery will be made as soon as possible after the stock is available and the payment for the goods has been received in the seller's account. The seller will deliver the goods/services within a maximum of 30 (thirty) days from the order date and reserves the right to extend this period by an additional 10 (ten) days with written notification. If, for any reason, the payment for the goods/services is not made or is cancelled in the bank records, the seller is considered relieved of the obligation to deliver the goods/services.

ARTICLE 6 - BUYER'S DECLARATIONS AND UNDERTAKINGS: The buyer shall inspect the goods/services subject to this contract before taking delivery and shall not accept damaged or defective goods/services from the shipping company, such as those with dents, breaks, torn packaging, etc. Acceptance of the goods/services implies acceptance that they are undamaged and in good condition. The obligation to carefully protect the goods/services after delivery rests with the buyer. If, after delivery of the goods/services, the bank or financial institution fails to pay the seller the price of the goods/services due to the unauthorized or unlawful use of the buyer's credit card by unauthorized persons, not attributable to the buyer's fault, the buyer is obligated to return the goods/services and the invoice to the seller within 3 (three) days, provided that they have been delivered to the buyer. If, after delivery of the goods/services, the buyer creates a defect on the goods/services that prevents their resale, the buyer is obligated to compensate for the price of the goods/services. In all cases, transportation costs shall be borne by the BUYER.

ARTICLE 7 - SELLER'S REPRESENTATIONS AND COMMITMENTS: The Seller is responsible for delivering the goods/services subject to this contract in sound and complete condition, conforming to the specifications stated in the order, and with any warranty documents and user manuals, if applicable. If the goods/services subject to this contract are to be delivered to a person/entity other than the Buyer, the Seller cannot be held responsible if the recipient refuses delivery. The Seller shall refund the price of the goods/services and any valuable documents within 7 (seven) days of receiving the notice of withdrawal. The Seller shall retrieve the goods/services within 20 (twenty) days. For justifiable reasons, the Seller may supply the Buyer with goods/services of equal quality and price before the performance period stipulated in the contract expires. If the Seller believes that the performance of the goods/services has become impossible, they shall notify the Buyer before the performance period of the contract expires. The paid amount and any documents shall be returned within 20 (twenty) days. Goods/services sold with or without a warranty certificate that are found to be defective or faulty may be sent to the seller for necessary repairs within the warranty terms; in this case, the delivery costs will be borne by the Buyer.

ARTICLE 8 - CHARACTERISTICS OF THE GOODS/SERVICES SUBJECT TO THIS AGREEMENT: The type and nature of the goods/services, quantity, brand/model, color, and the sales price including all taxes are as stated in the information on the goods/services description page on the website www.nutrafine.com and in the invoice, which is considered an integral part of this agreement.

ARTICLE 9 - CASH PRICE OF GOODS/SERVICES: The cash price of the goods/services is included in the invoice sent to the customer along with the product at the end of the order.

ARTICLE 10 - CREDIT PRICE: The price of the goods/services according to the payment term is included in the sample invoice emailed after the order is placed and in the invoice sent to the customer along with the product.

ARTICLE 11 - INTEREST: The interest rate shall be determined annually by the Government of the Republic of Turkey and shall in no case exceed 30%. The buyer is liable to the bank with which he/she works in accordance with the provisions of Article 13.

ARTICLE 12 - DOWN PAYMENT AMOUNT: The down payment amount for the goods/services is included in the sample invoice emailed after the order is placed and in the invoice sent to the customer along with the product.

ARTICLE 13 - PAYMENT PLAN: If the buyer makes a purchase using a credit card and in installments, the installment plan selected on the website shall apply. The relevant provisions of the agreement signed between the buyer and the cardholder's bank shall apply to installment transactions. The credit card payment date shall be determined by the terms of the agreement between the bank and the buyer. The buyer can also track the number of installments and payments from the account statement sent by the bank.

ARTICLE 14 - RIGHT OF WITHDRAWAL: The Buyer may exercise the right of withdrawal within 7 (seven) days from the date of delivery of the goods/services subject to this contract to himself or to the person/entity at the address indicated. To exercise the right of withdrawal, notification must be given to the Seller by e-mail within the same period, and the goods/services must be returned in their original packaging and contents, undamaged during testing and in a condition suitable for resale, in accordance with the provisions of Article 15 and the preliminary information published on the www.nutrafine.com website, which is an integral part of this contract. If this right is exercised, the original invoice for the goods/services delivered to the third party or the Buyer must be returned. The price of the goods/services will be refunded to the Buyer within 7 days following receipt of the withdrawal notification, and the goods/services will be returned within 20 (twenty) days. If the original invoice is not sent, the VAT and any other legal obligations cannot be refunded to the Buyer. The delivery and shipping costs for goods/services returned due to the right of withdrawal are borne by the Buyer.

ARTICLE 15 - GOODS/SERVICES FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED: Goods/services that are non-returnable due to their nature, perishable goods/services with expired expiration dates, single-use goods/services, and all types of software and programs that can be copied. Furthermore, for all types of software and programs, DVDs, DIVX, VCDs, CDs, MDs, video cassettes, computer and stationery consumables (toner, cartridges, ribbons, etc.), and cosmetic products, the right of withdrawal can only be exercised if the original packaging of the goods/services is unopened, undamaged, and unused.

ARTICLE 16 - DEFAULT AND LEGAL CONSEQUENCES: If the Buyer defaults on transactions made with a credit card, the Buyer will be liable to pay interest and be responsible to the card-issuing bank in accordance with the credit card agreement between the Buyer and the bank. In this case, the relevant bank may resort to legal action; it may demand the resulting costs and attorney fees from the Buyer, and in any case, if the Buyer defaults on the debt, the Buyer agrees to pay the Seller for any loss and damage incurred due to the delayed performance of the debt.

ARTICLE 17 - COMPETENT COURT: In disputes arising from this contract, Consumer Arbitration Boards shall have jurisdiction up to the value declared by the Ministry of Industry and Trade, and Consumer Courts shall have jurisdiction for disputes exceeding this value. In places where a Consumer Court is not available, the Civil Courts of First Instance shall have jurisdiction.
